Luke Rainbird
There is atleast a 30 metre distance before the gate where she could of gatherd some speed. Its meant to be 5-10 mph out of a school driveway and your meant to go really slow and look both ways. She did neither which proceeded in me bashing in to her car. There was absolutly f**k all i could do to stop myself.Ok, so she could have got some speed, though if it was onto a busy road it's unlikely she would have doneMaybe she did neither, but even so you shouldn't have been on the pavement, so it's not a case of "she's in the wrong" really is it?She's gonna see it from the "you bashing her car" perspective, which you've admitted anyway, so there's not a lot you can do

dave85
Witnesses who were actually there, or your mates?EDIT: also bugger all help having witnesses who are going to incriminate you by saying you were on the pavement too
RobinJI
The way I'd see it, blame falls both ways, but in the law, they'd favour her. So legally, she could ask you to fix it. But then if she's got any decency she'll just claim on the insurance, and ask for the like 20 quid a small claim would put up a middle aged woman's insurance next year.A while ago one of my mates was sat in stationary traffic in his car and a cyclist ran straight into the back of his car and face planted the back windscreen. haha, the guy was fine and so was the car, so they both just pissed themselves once he'd come around a bit! haha. TomR
Depends if it was a junction or a vehicular crossover as to who has priority.
Danny Kearns
Right she's phoned. She is claiming it is my fault and she is saying that it's going £250 to repair when the dent is only 6" long and half an inch in depth. She is saying that she has phoned her insurance company and that she can not claim because it is not another car that has hit her.Danny. Yes.I got one at a boot fair, 2 quid. Brand new.Bint.Was it a nasty dent or a push in one?I'm surprised she's doing what she's doing, she sounded like a nice woman when it actually happened. Si-man
Unless you have a metal spike embeded in your head, then the dent will come out piss with just a push and pressure on the other side abit. She sounds like a fanny really, runs you over then has the cheek to get you to pay, they should have mirrors up on the walls if pullout isnt to visible.Go to her house, tell her to pop the bonnet and do it yourself infront of her, then just walk off. Joe Sheehan!
Do something to yourself i.e. sprain your wrist and claim that it was her fault. On a serious note, theres not a lot you can do, because you said sorry. If youre lucky, she didnt hear you say it.

Danny Kearns
We have told her were not paying for it. If she wants it she's going have to take us court for it. I went down the police station with 3 whitenesses and we all give statements which were similar. She only has 1 whiteness. They said we shall just review over everything and get back to you both.See what happens.Danny.

Prawny Baby
if you ran into the side of my car and left a dent that was 'only' about 6'' long and 1/2'' deep, id make you pay good a proper.chances are even if it can be 'popped' out there will be ripples left, or paintwork damage when you examine it closely.at the end of the day, id give bennefit of the doubt to the lady in the car.riding a bike around like a loon doesnt tend to have such serious consequences as driving a car.....chances are, if she was pulling out of a SCHOOL, onto a MAIN ROAD, she wasnt going that fast.you on the other hand, were illegally speeding along the pavement, and failled to slow down appropriately when approaching the junction, who cares if it 'looked' clear? it obviously wasnt, you need to be ready for all eventualities. that means slowing down when your approaching what sounds like it must have been a blind gate.learn from your mistakes. because you were at fault. Danny Kearns
So she has right of way ? She is in all fairness driving across a public footpath. What would the situation be like it it was a little kid that ran out instead ? Would of been a completely different story then wouldn't it ? She should of edged out slowly and looked both ways but the dick didn't.Danny. Edited June 5, 2007 by Danny Kearns
Prawny Baby
tough one danny, just read my post, and it sounds a little harsh.....but i think technically, you are in the wrong.just telling her to f**k off isnt going to do anyone any favours is it.legally speaking, i think you are at fault, meaning you are obliged to pay for the damage.disputing the repair cost is pointless, as damage to cars ALWAYS costs more to repair than you would think possible......try going at it sensibly, perhaps offer her £100 as a good will gesture or something? Danny Kearns
I never told her to f**k off mate. Also. If it is a blind spot, by law shouldn't it have mirrors ?Im not offering her any money. I need a new front wheel now and i think she has slightly bent my zoo forks. She is yet to realize she only has one whiteness and i have 3.Bah. Im not paying up. Not a chance in hell. I will go to court over this. I don't have £250 anyways. Im at school and un-employed and theres no force on heaven or earth that will make me sell my bike to fund it.Where theres a will theres a way my friend .Danny xx
