Hay all,

To cut a long story short, Ive seen a mate drive off pissed out of his face, gave a statement the next morning and that was that.

The police are now wanting to talk to me about going to court, so I want to know what are my rights when it comes to removing statement or/and moving the court date. The reason for this is because I basically have my A-levels coming up and the last bloody thing I need is to be stressed out in and over court.

Yes the guy deserves it. I know, but "I'm having me doubts".

Legal advice needed. Fast.

Even though you would have signed a legal statement which is not retractable, if you chose not to appear in court then the case would be chucked out with lack of evidence for the charge as you and your statement are the said evidence.

They cannot present the witness statement without the witness, nor can they make you go to court, its your call.

Oh I got a bit wrong It seems you can retract a statement but be careful they don`t do you for wasting police time.

I don't really know much about the legal side of it, but people die becuase of people like this. My GF was knocked down (by a sober driver mind) ages ago and has been left brain injured. If it takes the court case to strighten him out, so be it.

I doubt there'll be much stress involved going into court, i mean it's not like he's killed anyone. And all you need to say was i saw him drive off pissed, and that's it. Don't back out of it.

Yeah I can understand you'd be scared, I would be, especially if it was a friend.

BUT

What he did was f**king silly - I HATE drunk drivers, or anyone that drives like an arse - In fact I was delivering furniture not too long ago and the guy driving the van was a lunatic. It got to the point where I said stop the van - He was either going to kill us or someone else. In the end I said if he didn't start driving properly I'd get out and make my own way home (200 Miles from home, but that's not the point - I'd have got the train on company expenses).

So yeah, he deserves it and needs to learn his lesson.

It's just lucky nobody was hurt - the only time I condone people being hurt is when the driver wipes himself out into a lamp post and has long term injuries - might sound harsh but they should use some braincells before driving whilst hammered.

I was at a party once and my mates older brothers mate drank about 20 cans of Fosters then went to drive home.

Ended up wrapped around a tree, no word of a lie, 50m down the road.

He had a f***ed leg and got 12months Porridge.
