Contact Ebay, I think you can do something under the Trades Discriptions Act...but not 100%. Ebay probably introduced shit loads of loopholes in the law. But contact Ebay and they'll start you off, if you ever get a reply.

Also, contact the seller, I find trials riders to be really honest when it comes to selling parts, and dont think they're out to rip you off...although, I could easily be wrong, where did you buy it from (county) maybe someone on here might know something about it.

Yeh and as you paid by paypal dave there should be more of a chance of getting something back possibly - IF you get your mum to phone him.

BUT on the other hand the mood you were in when it came did amuse me for a short period of time. :P

Definetly try and get money back but at the end of the day its a preety nice frame with some mint parts on.

Quick look over that link, seems very vague. Also, its a 2003 model...I'd be suprised if it were in amazing condition.

And finally, you left your feedback a bit early :P

They seem to have bought some other bike parts (kona and forks) so they seem pretty keen on bikes. Try contacting them directly or something, money back maybe?...but good luck all the same :P

You press the reply button underneath their comment dave and it will automatically come up with their message in a quote.

Sorry if this sound's a little harsh, but realistically you won't have anything done. I had exactly the same problem and Ebay passed me onto paypal. I then had to file a complaint but nothing was done because paypal said that I could have destroyed the bike :S . You can try though although don't get your hopes up.

There is a big difference between lack of description and falsified description. The only thing stated is that it is "used", which it quite clearly is. No other claims, apart from a list of parts, are made for the bike. Therefore I don't think you have a leg to stand on. Paying £390 for a £1000+ bike, particularly a trials bike, would seem likely to be a recipe for receiving a pretty hammered bike. Are peoples expectations of what they are buying too high?

^says the man with an appaling level of customer service on ebay who recently sold someone i know a "new" zona zenith that had obviuosly been built and ridden!

I think that the seller should have at least mentioned that there were scratches or dents if they are obvious. there is an appeal procedure on ebay through paypal but you need to be quick.

As the bike was labed used, he hasn't technically done anything wrong.

However he should have put up a better description, and you could have asked questions about the bike.

Is it all in good working order? If yes, then really there's not much you can do about it.

It does look rather nice to be honest. In future try and get some more pictures and if possible meet them in person before any cash can be handed over.

I hope the bike isn't too bad and you get your moneys worth of enjoyment out of it. Which i'm sure you will.

It is awsome so nice having no brakes or dralier to worry about the lightest bike i have ever had.

I am getting realy good on the back whel i can now do 23 back wheel hops it is like a pogo stck :D .

The Zona Zenith frame you mentioned was clearly described as a prototype, had a different colour and no decals. He paid less than half price for it and after an exhaustive investigation ebay/paypal found completely in our favour. Like I said in my posting, peoples expectations can be too high sometimes when buying goods on ebay. New, standard range items sold without any other proviso's should be as new. Anything second hand or described as prototype, experimental item or design concept can be expected to have been built and messed about with. That is why they are cheaper than standard new items. If he had wanted a brand new Zona Zenith frame they are on our website for £299 , not the £132 he paid for his.

I wouldn't have known that.

If i saw that it said on ebay 'condition: new' i'd expect it to be unused. Even if it was a prototype.

thanks to everyone for there help, it is much appreciated. i don't know whether any of you guys are interested but we have phoned and texted the guy with no reply so i believe he had bad intentions from the start, and seems unlikely that i will get any money back, but i have sent the front brake to my bike shop to be bleed and i can live with the scratches because of my crazy riding style its going to get smashed around anyway and is a very nice bike to ride so i'm pretty happy after all.
