 How the hell can u see BB usage from that page...

Thats what i was thinking.

Are you sure they've not just used a thread cleaning tool on it? If they had paint or anodising over the bb threads they might have cleaned them off so you wouldn't have had any problems fitting your bottom bracket. It would give the impression a BB has been fitted to it.

If it was on the shelf in their shop it might have got scratched when people look at it or employees moved it.

The product you have recieved isn't satifactory.. your reasons for this as everyone agrees are accurate, so get complaining.. Don;t get your hopes up to much, legally they don't have to do you any favours.

If its stated as new only its been built up then it is not entirely new and yes they are legally responsible for fraudulantly selling it. Same way as if a shop makes a mistake with the price of something, they have to sell it at that price, we got our sofa for £180.00 because someone had put the decimal point in the wrong place so we saved £1600.

I've been trying to ring them about my tyres as well and have had no luck, it amazes me at how incompetant this place can be. I placed my order for a pair of tyres with them and was told they would be at my house by the end of the week, i've not even had the money taken out my account... they've just comepletely forgotten about the order, their loss the money went on booze and a taxi last night

This may not be especially helpful but in the 3rd pic down on the Ebay page you can see the chain slap damage that you took a photo of. So it was obviously "damaged" when they were selling it. Question is whether them stating it was new on the ebay page means they sold you something not as described, in which case you should be able to get at least some money back. But as the damage is obvious you may be unlucky.

they could just say the bike was built for the purpose of the shop, like having a demo. Which it may possibly have been, if this is so the frame is still new as it has not been previously sold.. hence ' no they won't have to do you any favours'. They may feel sorry for you and help you out anyway.

Yes but you have a choice of new or used on the ebay site and they have chosen to mislabel something that is clearly and inarguably not new but used. Therefore its a breach of ebay selling rules and is applicable to go through ebays "item not received or significantly not as described" channels to require some sort of an alternative or refund. It is also against the trade descriptions act.

They HAVE to sort it out.

First post - YES you are ...

thats not true - they dont have to, generally they do to keep you happy but by law they can refuse to sell it to you.

anyway - Id ask for a shed load of money off the price you paid, and if they get shirty threaten them with all sorts of action - reports to ebay for starters and maybe even taking them to small claims court ?

give em some shit.

Have pm'd you will sort it out when you get back from work. I have put a dispute thing on ebay after supercycles not answering or replying via ebay. I am asking for half of what the final price was back which I consider to be fair as it has been used and marked and also my hassle of having to do this when the seller should have sold a properly described item.
