Business people please help

Hi,

My friend and I have set up our own company and in the design phase of all our products etc..

We just realised that there is a company with the same name as us that deals with the same category of products.

So as an example their name is 'Company Name', but ours is 'Company Name Co.'. We don't want to get sued or anything for having the same name as them, does the 'Co.' at the end make it different? - We wanted to be unique and this certainly doesn't help, however their company doesn't seem to be too popular at the moment. Could be wrong though.

Any help/advice would be good. Please only serious answers though, fed up of all the sarcastic rubbish that happens on TF.

Get a unique name, if not for the legal issues then for the fact that you want your brand to be yours in your own right. You don't want people searching for you finding the other company, right?

Very true. Shame though, because we had our logo made and everything. Liked the name a lot.

If that company is failing now surely it's not the best idea to use their name anyway regardless of the legal situation?

Just doesn't make sense to me.

I'm not 100% sure on their popularity. Just going by their Facebook likes, which is impractical really. I shouldn't of even said it to be fair.

If the 'company name' has anything to do with your personal names then you're ok. Like if my name was Jeff Microsoft, I could open up a store called Microsoft Computers. Although that would be silly anyway.

Have you completed sufficient due diligence? As if you are comparing competitors via 'likes' on Facebook it doesn't sound like it. This isn't a dig just trying to help.

We aren't comparing via Facebook Likes. This is how I found out there was a company with the same name. Just a Facebook search and Google search to check, which turned out there was one.

Uh oh.

Nothing is free, and the most expensive thing you can use is your time. If you value your time at £100 per hour, for instance, then that logo definitely cost you something. Everything you do in business has a cost, especially in that you could be doing something else instead. The key is in working out which is worth the most at any given point. For instance, 10 minutes checking the name would have saved you that time that you've now got to spend again. If each logo takes you 4 hours (I'd reckon that was low on the scale for something well thought out) then you've just cost yourself £400 in time - oops.

Sorry but you have asked for help from 'business people' and when given you are either, in my case ignoring it, or just trying to back up that what you have done is correct. You need to learn to listen and then educate yourself; until you do this you will not get very far.

Not sure if this was intended to have me in with the 'business people', but I felt I should clear up anyway, I'm not a business person, I tried it and it's far too complicated, stressful and difficult to make decisions for me. I'm now strictly an employee for other people. I don't even like doing freelance web development work because than means asking people for money.
