I sold a 2nd hand exhaust - centre section and rear section for around the going rate for just the centre section since the rear has a big hole in it. Hole was documented and photographed. Seller has filed a significantly not as described dispute and wants half the money refunded. He says there are lots of other holes and a crack. Has anyone any experience of this sort of thing? I've responded saying the large hole is the only functional problem with the exhaust and that was clearly described. I've offered him a 50p refund! Any thoughts? Request for him to send photos of the 'damage' that wasn't listed, and qoute the ebay listing to proove that he was made aware of the hole in the rear section. You can offer a full refund once you receive the item, but chances are the person wont bother as they have to pay the courier fee to get it back to you (you are not obliged to pay this), by making this offer of a refund and him not sending it back, he will therefore lose his entitlement to any refund. It's not through ebay - it's through a car forum (from which he's now banned!) It annoys me that he's already talking crap to Paypal - says he asked about the condition of the exhaust 5 times, when he only asked once, which makes me think he'll say anything to Paypal to get his way. The only way you can prove that he asked once is by taking screen shots, basically just evidence it up. How much is the exhaust worth? Krisboats Posted April 23, 2011 Report Share Posted April 23, 2011 Another good one is to ask him to take high detail photo's of the item from all sides clearly showing the damage. Tell him you did took date stamped photo's yourself before sending it out and you're quite happy to send your photo's to paypal so they can compare the before/after shots. Sounds like he would be the kind of person to add extra holes to it just to get his own way. Also paypal should state that he has to provide a tracked parcel number to show he sent it back before they refund the money. I know ebay do and as they're the same company i'd have thought paypal would have the same/a similar procedure. So expect a delivery of bricks/yellow pages sometime soon. Providing date stamped photo's to paypal would be the only real way to aid your case though. I take them from each side now and close ups of any damage just to prevent things like this. Also send a link to his forum profile showing him to be banned. I linked a complaints page for a usenext case i made and had my money fully refunded, i believe largely in part to the testimonials of other people in the same situation. Attacking his character would appear immoral however would most likely work in your favour. The only sure advice however is to write this one off to experience and accept that you've lost the money, this way it'll be rather nice if you win. Unfortunately the chances are slim. I've escalated it to a claim, given all details and said I'll refund £20 if he returns the backbox as it's by no means scrap. Will be curious to see how Paypal handle it...
